1. Use of Service
Clearbound Safety provides an AI-powered safety evaluation tool intended solely for early testing and demonstration purposes. The results are for informational use only and are not guaranteed to be accurate, complete, or suitable for regulatory compliance.
2. Video Submissions
By submitting any video footage to our platform, you agree that:
- You have the legal right, ownership, or explicit permission to upload the footage.
- You grant Clearbound Safety a non-exclusive, royalty-free, worldwide license to analyze, temporarily store, and use your footage for testing, quality assurance, and product development.
- Footage may be retained temporarily and used solely to improve AI model performance.
- We do not capture, store, or attempt to identify any individual’s identity (including biometric or facial recognition data).
3. No Warranty
The service is provided “as is” without warranties of any kind, express or implied. Clearbound Safety disclaims any liability for reliance on the results or reports generated.
4. Limitation of Liability
To the maximum extent permitted by law, Clearbound Safety shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the service.
5. Indemnification
You agree to indemnify, defend, and hold harmless Clearbound Safety, its officers, employees, contractors, and affiliates from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your video submissions, including any alleged unauthorized or unlawful content;
- Your violation of these Terms; or
- Any third-party claim alleging infringement of privacy, publicity, or other rights resulting from your submissions or use of the Service.
6. User Responsibility for Compliance
You are solely responsible for ensuring that any video footage submitted through the Service complies with all applicable workplace policies, labor agreements, privacy regulations, and laws in your jurisdiction. Clearbound Safety makes no representation or warranty that the use of this Service will, by itself, satisfy your legal or regulatory obligations.
Compliance with Biometric and Privacy Laws
Clearbound Safety does not capture, store, or process biometric identifiers or biometric information, including but not limited to facial recognition or fingerprint data, as defined under the Illinois Biometric Information Privacy Act (“BIPA”) or any similar laws in other states. Users are responsible for ensuring that any video footage submitted complies with applicable state and federal privacy laws. Clearbound Safety expressly disclaims any liability for violations of BIPA or other biometric or privacy statutes arising from user-submitted content.
7. Authorized Users
By using this Service, you represent and warrant that you are at least 18 years old and an authorized representative of your company, with the authority to upload and share video footage on its behalf.
Application to Employees, Contractors, and Affiliates
These Terms and Conditions apply not only to customers and companies using the Service, but also to their employees, contractors, agents, and any other individuals or entities who upload, provide, or otherwise interact with video footage or data through the Service.
8. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions.
Venue and Jurisdiction
Any dispute or claim arising out of or relating to these Terms shall be brought exclusively in the federal courts located in the Eastern District of Wisconsin, which shall serve as the venue of record. You agree to submit to the personal jurisdiction of such courts and waive any objection based on inconvenient forum or lack of jurisdiction.
9. Class Action Waiver
To the fullest extent permitted by law, you agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved on an individual basis. You expressly waive any right to pursue or participate in a class action, collective action, or representative proceeding against Clearbound Safety.
10. Updates
We may update these Terms at any time. Any changes will be posted on this page with an updated effective date.
